Terms of service
These Terms of Service ("Terms") govern your access to and use of torshift.com (the "Site") and purchases from TORSHIFT. TORSHIFT is operated by TEMBLEM LLC.
These Terms, together with our Privacy Policy, Return, Exchange & Refund Policy, Shipping Policy, and other policies posted on the Site, describe the rights and responsibilities that apply when you use our services or place an order.
Effective date: September 13, 2026
1. Eligibility
You must have reached the age of legal majority in your place of residence, or otherwise have valid permission from a parent or legal guardian, to use the Site and place an order.
You agree to provide current, complete, and accurate information when using the Site or placing an order.
2. Our Store and Shopify
TORSHIFT uses a custom headless storefront for customer-facing website experiences and uses Shopify for certain ecommerce infrastructure and services, which may include product and cart functions, checkout, payments, order processing, fraud prevention, security, and related commerce services.
Shopify is not the seller of TORSHIFT products. Unless otherwise required by law, sales are between the customer and TEMBLEM LLC, operating as TORSHIFT. We remain responsible for our products, fulfillment, customer service, returns, and refunds.
3. Product Information
We make reasonable efforts to display product descriptions, specifications, measurements, compatibility information, colors, materials, and images accurately. Screen settings, lighting, manufacturing variations, and other reasonable variations may affect appearance.
Product details, availability, and prices may change without notice. Product-specific information displayed at the time of purchase forms part of your order.
Information on the Site may occasionally contain typographical errors, inaccuracies, or omissions. Where permitted by law, we may correct information or cancel an affected order. If we cancel an order after payment has been charged, we will issue the applicable refund to the original payment method.
4. Vehicle Compatibility and Customer-Provided Information
You are responsible for reviewing the vehicle make, model, year, version, specifications, configuration details, and compatibility information presented on the Site and for providing accurate information when requested.
If you are uncertain about compatibility, contact support@torshift.com before ordering or before fulfillment when possible.
If TORSHIFT's product information or a written compatibility confirmation from our support team was materially inaccurate, the issue will be reviewed under our Return, Exchange & Refund Policy. Customer-selected errors involving an otherwise accurately described vehicle, year, model, version, specification, or configuration are handled under that policy as well.
5. Orders and Acceptance
An order confirmation acknowledges that we received your order; it does not necessarily mean the order has been finally accepted. We may reject or cancel an order for reasons including unavailable inventory, inaccurate product or pricing information, suspected fraud, payment problems, delivery restrictions, or legal requirements.
If we cancel an order after payment, we will refund the amount paid for the canceled item to the original payment method.
Cancellation and modification requests should be submitted within 24 hours of purchase. Once an order has been handed to the carrier, cancellation or modification may no longer be possible.
6. Prices, Currency, Taxes, and Import Charges
Prices are displayed in the currency shown on the Site or at checkout. Exchange-rate or card-provider fees may apply when your payment account uses another currency.
Applicable taxes and shipping charges are displayed at checkout where relevant. Orders accepted through our checkout are arranged so that customers will not be required to pay additional customs duties or import fees upon delivery. If an unexpected import-related payment is requested, contact us before paying it.
7. Payment
You agree to provide current, complete, and accurate billing and payment information. Payment methods available to you are displayed at checkout and may be processed by Shopify or other payment providers.
You represent that you are authorized to use the selected payment method. We may hold, reject, or cancel an order when payment cannot be authorized or when additional verification is reasonably required.
8. Shipping and Delivery
Order processing, shipping methods, charges, and delivery estimates are described in our Shipping Policy. Delivery timeframes are estimates unless expressly stated otherwise.
You are responsible for providing a complete and accurate delivery address. Nothing in these Terms removes any responsibility that cannot lawfully be excluded.
9. Returns, Refunds, Cancellations, and After-Sales Support
Returns, refunds, replacements, cancellations, compatibility-related requests, and after-sales support are governed by our Return, Exchange & Refund Policy.
TORSHIFT does not currently offer a separate fixed 12-month limited commercial warranty unless a different written warranty is expressly stated for a specific product in the future.
Nothing in these Terms limits any mandatory consumer right or remedy.
10. Product Use and Installation
You are responsible for using and installing products in a safe and appropriate manner and for following applicable instructions. Where installation requires technical knowledge, wiring, vehicle disassembly, or other specialized work, appropriate care should be taken and professional assistance should be considered where appropriate.
Damage caused by misuse, abuse, unauthorized modification, improper installation, incorrect connection, or use outside the product's intended purpose may not qualify as a product-quality issue, subject to applicable law.
11. Reviews and Other User Content
If you submit a review, photograph, video, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not infringe another person's rights.
You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that content for operating, improving, and promoting our business, subject to applicable law and our Privacy Policy. We may remove content that is unlawful, misleading, abusive, infringing, or irrelevant.
12. Intellectual Property
The Site and its text, graphics, photographs, videos, designs, logos, product presentation, and other content are owned by or licensed to TORSHIFT or TEMBLEM LLC and are protected by applicable intellectual-property laws.
You may use the Site for personal, non-commercial shopping purposes. You may not copy, reproduce, distribute, modify, sell, exploit, or create derivative works from Site content without permission, except as allowed by law.
13. Third-Party Names and Compatibility References
Third-party brand names, product names, vehicle names, model names, and trademarks may be used only to identify compatibility or describe intended use. Unless expressly stated, TORSHIFT is not affiliated with, sponsored by, endorsed by, or officially licensed by those third parties.
14. Prohibited Uses
You may not use the Site:
- For unlawful, fraudulent, abusive, or deceptive activity
- To infringe intellectual-property, privacy, publicity, or other rights
- To transmit malware, harmful code, spam, or unauthorized automated requests
- To interfere with Site security, operation, or another person's use
- To collect personal information without authorization
- To submit false information, impersonate another person, or make unauthorized purchases
We may restrict access or cancel affected orders when reasonably necessary to protect the Site, customers, or our legal rights.
15. Third-Party Services and Links
The Site may contain third-party services, tools, integrations, or links that we do not control. Your use of those services may be subject to the third party's own terms and policies.
To the extent permitted by law, we are not responsible for issues arising solely from the operation of an independent third-party service.
16. Disclaimer
To the fullest extent permitted by law, the Site and its general content are provided on an "as available" basis. We do not guarantee uninterrupted or error-free access.
Nothing in this section excludes any product responsibility, statutory guarantee, or consumer right that cannot lawfully be excluded.
17. Limitation of Liability
To the fullest extent permitted by law, TEMBLEM LLC, TORSHIFT, and their directors, employees, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Site or products.
Where liability can lawfully be limited, our aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any other liability or consumer right that cannot lawfully be excluded or limited.
18. Indemnification
To the extent permitted by law, you agree to be responsible for losses and reasonable costs arising directly from your unlawful use of the Site, your material breach of these Terms, or your infringement of another person's rights.
19. Privacy
Our collection and use of personal information are described in our Privacy Policy.
20. Severability and Waiver
If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver of that provision or any other right.
21. Applicable Law and Mandatory Rights
These Terms are subject to applicable law. No exclusive court, jurisdiction, or mandatory arbitration forum is designated by these Terms.
Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded in your place of residence.
22. Changes to These Terms
We may update these Terms by posting a revised version on the Site and changing the effective date. Changes apply prospectively unless applicable law requires otherwise.
